Hallandale Beach Condo Rental Restrictions: Association Rules, City License and Taxes

Key takeaway: Whether you can rent out a Hallandale Beach condo, and for how long, is decided first by your association's declaration and rules, not the city. Florida law stops the city from banning vacation rentals but doesn't stop an association, though an amendment restricting rentals binds only owners who consent or buy after it passes. If the documents allow stays under 30 days, you then need a city vacation rental license ($300 a year), a state lodging license and an account to collect 13% in state and Broward taxes.
| At a glance | |
|---|---|
| Who sets lease minimums | The condo declaration and rules (F.S. 718.104(5)) |
| Newer rental restrictions | Bind only consenting owners and later buyers (F.S. 718.110(13)) |
| City vacation rental license | Required yearly for stays under 30 days; $300, plus $25 BTR |
| City penalties | $250 first offense, $500 after |
| Occupancy | Maximum 4 per bedroom |
| State license | DBPR public lodging license (F.S. 509.241) |
| Taxes on stays of 6 months or less | 6% state + 1% Broward surtax + 6% Broward tourist development tax = 13% |
| Zillow typical rent (Sept 2026) | $2,455 a month |
Hallandale Beach Condo Rental Restrictions Start with your Declaration
For a condo, the city license is the last gate, not the first. Florida law lets a declaration include covenants and restrictions on the use, occupancy and transfer of units (section 718.104(5), 2026 statutes), and that's where minimum lease terms, rental caps and tenant approval live. If your building's documents say leases must run a year, no city license changes that. Read the documents before you buy furniture or sign with a manager.
Lease minimums and rental caps in the declaration
Look for three things: a minimum lease term (30 days, 90 days, six months, a year), a limit on how many times a unit can be leased in a year, and any waiting period after purchase before you can lease at all. These can sit in the declaration, the bylaws or the rules and regulations, so ask the association for all three plus every recorded amendment.
Association approval of tenants
If your declaration requires the association to approve a lease or a tenant, expect an application fee and a processing time. That timeline can rule out short stays even where they're technically allowed. Ask for the lease application, the fee and how many days approval takes. How association approval works on a sale is in our guide to buying a condo in Florida.
718.110(13): When a new condo rental restriction doesn't bind you
Under section 718.110(13), an amendment that prohibits renting, changes the allowed rental term or limits how often owners can rent applies only to owners who consent to it and to owners who take title after it takes effect. So the date of each rental amendment, set against the date you took title, decides which rules you live under. If you buy, you take the rules in force on your closing date; the previous owner's protection doesn't pass to you. More on the condo statute in our overview of Florida condo law.
Condo Rental Restrictions the City Adds: The Vacation Rental License
Who needs a Hallandale Beach vacation rental license
Under Ordinance 2023-003, every owner of a vacation rental needs an operating license, renewed every year. It applies to any property, including rooms and guest houses, rented for less than 30 consecutive days. Leases of 30 days or more don't need it, though the association's rules still do.
Vacation rental license fees and penalties
| City fee or penalty | Amount |
|---|---|
| Vacation rental license | $300 |
| Business tax receipt / vacation rental license | $25 |
| Late registration | $75 |
| Application modification | $100 |
| Reinstatement after suspension | $100 |
| Appeal | $200 |
| Penalty, first offense | $250 |
| Penalty, second or later offense | $500 |
Operating without both the business tax receipt and the vacation rental license violates Chapter 9 of the city code. An incomplete application can sit in pending status and lose its processing fee, so use the city's checklist.
Rental agent, occupancy and posting rules
The city's checklist asks for a notarized application signed by the owner, manager or agent; your state lodging license; proof of an account with the Broward County Tax Collector; a floor sketch showing parking, fire extinguisher, smoke detector and exits; an evacuation route map; a sample of the posted notice; and a current local business tax receipt. The rental agent must be reachable 24 hours a day, able to be on site within 60 minutes and must inspect the unit after every rental. The unit needs a landline, and occupancy is capped at four people per bedroom.
What the city can't restrict: section 509.032(7)
State law bars a local law from prohibiting vacation rentals or regulating how long or how often they're rented, unless the local rule dates from on or before June 1, 2011. That's why the city licenses and inspects rather than bans. The preemption covers city and county rules only; it says nothing about a condo declaration, which is a private covenant.
Condo Rental Restrictions From the State: The DBPR Lodging License
Florida vacation rental license from DBPR
A condo unit becomes a vacation rental under section 509.242 when it's a transient public lodging establishment, defined in section 509.013 as a unit rented more than three times in a calendar year for less than 30 consecutive days, or advertised as regularly rented that way. Every public lodging establishment needs a license from the Division of Hotels and Restaurants at the Department of Business and Professional Regulation, and operating without one is a second-degree misdemeanor under section 509.241. The city won't issue its license without the state one.
Taxes on a short-term condo rental in Broward County
Rentals of six months or less owe three taxes, filed in two places. A lease of more than six months for continuous residence is exempt from the state tax under section 212.03.
Florida 6% Transient Rental Tax
Section 212.03 levies 6% on the total rent charged for living quarters in a condominium. You register with the Florida Department of Revenue and report it on the DR-15 sales tax return.
Broward 1% Discretionary Sales Surtax
Broward's 1% surtax, in effect since January 1, 2019 and set to expire December 31, 2048, applies to transient rentals and goes to the Department of Revenue on the same return as the 6%.
Broward 6% Tourist Development Tax
Broward's local option transient rental tax is 6%, and Broward collects it itself rather than through the state, so it's a separate registration and a separate monthly return with the county's Tourist Development Tax Section. Broward's instructions say returns are due on the 1st and late after the 20th of the following month; confirm the current filing rules with the county.
Example: Taxes on a $3,000 Condo Booking
| Tax on $3,000 of rent | Rate | Amount | Paid to |
|---|---|---|---|
| Florida transient rental tax | 6% | $180 | Florida Department of Revenue |
| Broward surtax | 1% | $30 | Florida Department of Revenue |
| Broward tourist development tax | 6% | $180 | Broward County |
| Total | 13% | $390 |
Swap in your own booking total. If you list on a booking platform, ask it in writing which of these taxes it collects and remits for you, and file the rest yourself.
Long-term Leases: Fewer Condo Rental Restrictions Apply
Leasing a Hallandale Beach condo for six months or more
A lease of 30 days or more skips the city's vacation rental license, and a bona fide written lease of more than six months skips the transient rental taxes. You still need the association's approval if the documents require it, and you still follow its minimum term. Zillow's typical asking rent for Hallandale Beach was $2,455 a month in September 2026; rent and yield by building type are in the Hallandale Beach housing market report.
Renting also changes your tax and insurance position. The city's vacation rental page points owners to section 196.061 on renting homestead property, so read the property tax on a rental condo in Broward before you rent a homesteaded unit, and tell your insurer: a unit policy written for an owner-occupant may not cover tenants (see Florida condo insurance).
Managing a Rental under Hallandale Beach Condo Rental Restrictions
Checklist before you list a Hallandale Beach condo
- Get the documents. Declaration, bylaws, rules and every recorded amendment, with dates.
- Find your rental rules. Minimum term, rentals per year, waiting period, approval steps and fees.
- Check 718.110(13). Compare each rental amendment's effective date with your deed date.
- License if under 30 days. DBPR first, then the city's application with the checklist items.
- Register for taxes. Department of Revenue for 6% plus 1%; Broward County for the 6% tourist tax.
- Name a local agent. Someone reachable 24/7 and on site within 60 minutes.
What to ask a Hallandale Beach Property Manager
Management fees vary by service level, so get a written fee schedule that names the percentage of rent, cleaning charges, linen and supply costs, and who pays for repairs. Ask whether the manager acts as your city rental agent, files the tax returns, and handles the association's lease applications. Julia Ray is a licensed community association manager who managed a 200-unit Hallandale Beach condominium before becoming a broker, and she owns Raydiant Living, a vacation rental and property management company. If you'd like, I can read your building's rental rules and amendment dates with you and tell you which licenses and tax accounts the unit needs before you list it.
If the numbers don't work after the rules and taxes, compare them with a sale: selling a Hallandale Beach condo covers timing and approvals, and the Hallandale Beach condos for sale guide shows what buyers are comparing. Rental rules differ by tower; check the buildings in our guide to the oceanfront condos.

Hallandale Beach Condo Rental Restrictions FAQs
Can I Airbnb my condo in Hallandale Beach?
Only if your association's declaration and rules allow stays under 30 days. If they do, you need a Florida DBPR public lodging license, the city's yearly vacation rental license under Ordinance 2023-003 and a business tax receipt, and tax accounts with the Florida Department of Revenue and Broward County. If your condo documents set a longer minimum lease term, that rule controls, and the city can't override it.
Does Hallandale Beach require a vacation rental license?
Yes. Every owner of a property rented for less than 30 consecutive days needs an operating license, renewed yearly. The license fee is $300 plus a $25 business tax receipt, with a $75 late fee. Operating without one draws a $250 penalty for a first offense and $500 after that. The city also requires a state lodging license first.
What taxes do I pay on a short-term rental in Hallandale Beach?
Rentals of six months or less owe Florida's 6% transient rental tax and Broward's 1% surtax, both reported to the Florida Department of Revenue, plus Broward's 6% tourist development tax, reported to the county. That's 13% in total, or $390 on a $3,000 booking. A bona fide written lease of more than six months is exempt.
Can a Florida condo association ban rentals?
A declaration can restrict use and occupancy, including leasing, under section 718.104(5). But under section 718.110(13), an amendment that prohibits rentals, changes the rental term or limits how often owners can rent binds only owners who consent to it and owners who take title after it takes effect. Check each amendment's date against your deed.
How much does it cost to have someone manage an Airbnb for you?
There's no standard fee, so compare written fee schedules. Ask each manager for the percentage of rent, cleaning and linen charges, who pays for repairs, and whether the fee covers acting as the city's required 24/7 rental agent, filing the state and Broward tax returns, and handling the association's lease applications. Those duties are where quotes differ.
Does renting my Hallandale Beach condo affect my homestead exemption?
It can. The city's vacation rental page points owners to Florida Statutes section 196.061 on renting homestead property. Before you rent a homesteaded unit, confirm the effect on your exemption and Save Our Homes cap with the Broward County Property Appraiser or a Florida CPA, since losing homestead can raise your tax bill.
